On Nov. 28, 1995, plaintiff, a 54-year-old real estate developer, was driving westbound on Santa Monica Boulevard approaching Veteran when defendant's car accelerated out from a driveway and into plaintiff's path, resulting in a collision. The plaintiff brought this action against the defendant based on negligence theory of recovery.
