On Dec. 15, 1995, the plaintiff, a 54-year-old homemaker, was a passenger in a Lincoln Towncar on the San Diego freeway (Interstate 405) near Bel Air Crest Road in Los Angeles, when the defendant, driving his 1986 Honda Civic, failed to stop for traffic, striking the rear of the plaintiff's vehicle. The impact caused damage to the vehicle and injuries to the plaintiff. The plaintiffs, husband and wife, brought this action against the defendant based on negligence and loss of consortium theories of recovery.
