Facts

On Oct. 26, 1995, plaintiff Alan Zanger, a 50-year-old celebrity photographer, attempted to obtain videotape of Alec Baldwin and Kim Basinger arriving home from the hospital with their 3-day-old baby, from inside the camper shell of his pick-up truck. Baldwin approached the plaintiff's vehicle and applied shaving cream to the side windows of the camper shell to obscure the plaintiff's visibility. The plaintiff then exited the vehicle and was eventually struck in the face and kicked in the rear-end by defendant Baldwin. The plaintiff brought this action against the defendant based on assault, battery, intentional infliction of emotional distress and negligence theories of recovery.
