Facts

Defendant Alta Dottir prepared a grant deed purporting to gift a house owned free and clear by the seller. The conveyance was actually a sale. The defendant then encumbered the house with a lender and refused to pay over any percentage of the proceeds to the seller. The seller sold/assigned equitable mortgage to the plaintiff, who in turn judicially foreclosed out the putative buyer. The plaintiff brought this action against the defendants based on breach of contract, tort and real property theories of recovery.

Settlement Discussions

The plaintiff made a C.C.P. º998 settlement demand for $50,000. The defendants made a C.C.P. º998 offer of $20,000.

Damages

The plaintiff claimed $150,000 in damages.

Other Information

The verdict was reached approximately one year and six months after the case was filed. A settlement conference was held on April 11, 1997 before Judge Ronald Sohigian. It did not resolve the matter.
