Facts

On May 15, 1996, the plaintiff entered into a contract with the defendant to install audio, video and lighting equipment in the defendants night club. The plaintiff claimed it completed the job/contract in full, however, the defendant failed to pay for a portion of the remaining balance on the contract. The plaintiff brought this action against the defendant based on breach of contract theories of recovery.

Settlement Discussions

The plaintiff made a C.C.P. º998 settlement demand for $127,000. The defendant made a C.C.P. º998 offer of compromise of $117,000.

Damages

The plaintiff claimed $127,000 due and owing on the contract.

Other Information

The settlement was reached approximately nine months after the case was filed. A mediation was held on June 13, 1997 before Seymour Winston, Esq.
