Facts
Plaintiff Cassim Manjra, a machine operator, was employed by defendant Fairchild Industries in its aerospace fastener manufacturing facility for 28 years. In January 1995, the plaintiff was injured on the job but immediately returned to work with work restrictions. In May 1995, the plaintiff was laid off as part of a major force reduction. The plaintiff was later classified as permanent and stationary restrictions that rendered him unable to perform his job. When business picked up, the plaintiff was not rehired because he had not completed vocational rehabilitation. The plaintiff brought this action against the defendant based on discrimination and breach of contract. The plaintiff's claim for violation of the Americans with Disabilities Act (ADA) was dismissed on motion pursuant to Federal Rules of Civil Procedure Rule 50 at close of evidence.
