On Nov. 25, 1995, the plaintiff, a 49-year-old unemployed man, was driving a car north on Highway 101 near Pearcy in Mendocino County. The defendant was driving a car south on the same highway. The defendant lost control of his car, crossed over the median line and collided with the plaintiff's vehicle. The plaintiff contended that the defendant was negligent for losing control of his car and crossing over the median line. The defendant did not seriously contest liability. The plaintiff brought this action against the defendant based on a negligence theory of recovery.
