Plaintiff Judee Welch worked for defendant Ivy Hill Corporation from 1987 through March 2009 as a salesperson selling print to the music industry. During the last four and a half years of her employment, a new vice president was brought in to supervise her and the remainder of the sales staff. During those years, the supervisor made numerous ageist remarks against her and showed preference for hiring and supporting younger sales people. When the company was purchased in 2009, Welch was included in a layoff.
Plaintiff sued alleging age harassment, age discrimination and breach of implied contract not to terminate without good cause. She prevailed on the age harassment and breach of implied contract claims not to terminate without good cause.
