On Dec. 28, 1993, the plaintiff, a 76-year-old greeting card clerk, boarded an LACMTA bus. After boarding the bus, the plaintiff alleged that the bus operator drove wildly from the bus stop and, as a result of the whipping of the bus from left to right, allegedly caused a fracture on her wrist. The plaintiff brought this action against the defendant based on a negligence theory of recovery. The plaintiff contended that the driver violated the common carrier standard of care. The defendant contended that the accident did not occur as the plaintiff described, and the plaintiff could not sustain her burden of proof.
