Facts
On Dec. 28, 1993, the plaintiff, a 76-year-old greeting card clerk, boarded an LACMTA bus. The plaintiff brought this action against the defendant based on a negligence theory of recovery. The plaintiff contended that the driver violated the common carrier standard of care. The defendant contended that the accident did not occur as the plaintiff described, and the plaintiff could not sustain her burden of proof.
