Facts

On Oct. 8, 1996, the plaintiff, a 44-year-old sushi-maker, was a pedestrian at the intersection of Baristo Road and Sunrise Way in the City of Palm Springs. The defendant driver made a right turn from easbound Baristo to southbound Sunrise Way, hitting the plaintiff. The plaintiff brought this action against the defendant based on a negligence theory of recovery.

Settlement Discussions

The plaintiff made a C.C.P. º998 settlement demand for $250,000 (policy limits) which the defendant accepted.

Injuries

The plaintiff suffered a brain injury, requiring bilateral craniotomies and a partial lobectomy.

Other Information

The settlement was reached approximately eight months after the case was filed, before arbitration, disclosure of experts or a settlement conference.
