Facts
On Feb. 20, 1995, plaintiff, a 36-year-old salesman, stopped at bridge waiting for traffic in front of him to move. The defendant trucker was unable to stop in time and rear-ended the plaintiff's vehicle. The plaintiff brought this action against the defendant based on a negligence theory of recovery.
Settlement Discussions
The plaintiff made a C.C.P. º998 settlement demand for $1 million. The defendant made a C.C.P. º998 offer of compromise for $125,000.
Damages
The plaintiff claimed $1 million in damages, including a workers' compensation lien of $130,000.
Injuries
The plaintiff alleged soft tissue back, neck and knee injuries; a laminectomy to his back, following unsuccessful discectomies; and knee surgeries.
Other Information
The settlement was reached approximately two years and three months after the case was filed. MEDIATION: A mediation was held on Feb. 16, 1998, before Ken Gack, Esq., of JAMS, resulting in the reported settlement.
