Facts

On June 26, 1989, the plaintiff, Brenda Trujillo, a 32-year-old panel assembler at General Electric, underwent a left knee arthroscopy and lateral retinacular release, using a pneumatic tourniquet at 350 hhMg for seven minutes at the defendant hospital, Antelope Valley Hospital. Postoperatively, the plaintiff experienced severe ecchymosis, pain, numbness above the knee and quadriceps weakness. The plaintiff brought this action against the defendant hospital and orthopedic surgeon (dismissed on a motion for summary judgment) based on medical malpractice and negligence theories of recovery.

Settlement Discussions

The plaintiff made a C.C.P. º998 settlement demand for $400,000. The defendant made a settlement offer of a waiver of costs.

The verdict was reached approximately five years and six months after the case was filed. The court found that Title 22 applied, as a matter of law, and so instructed the jury.
