Facts

Plaintiff Marathon Entertainment Inc. entered into an oral contract to act as the personal manager of defendant Reginald Hayes, an actor. Under the management agreement, the plaintiff was entitled to receive 15 percent of the defendant's earnings. Soon after entering into the management agreement, the defendant's talent agency obtained a role for the defendant on the television series "Girlfriends." The defendant terminated the plaintiff after the first season concluded.
