Facts
On Feb. 2, 2002, the defendant Gazelle Transportation, Inc. drove up one of their tanker trucks onto land, the subject of an oil lease, owned and operated by the plaintiff, California Oil Independents. The defendant hooked up the tanker truck and hose to an oil storage tank and began pumping oil from the storage tank into the tanker trailer. In the course of pumping oil, there was an explosion in the storage tank resulting in a fire and the destruction of two oil storage tanks, certain other equipment and lost profits.
Settlement Discussions
The plaintiff initially demanded $350,000, subsequently reduced to $250,000 before trial. The defense offered $15,000, later increased to $70,000 before trial.
