In December 2002, plaintiff Sharlette Kurowski, age 29, was driving a Honda Accord north on Fresno Street approaching the Pontiac Way intersection. Defendant Brian Nicassio was driving a Toyota pickup truck west on Pontiac Way. As the plaintiff reached the intersection, the two cars collided. Both parties were able to drive away from the scene and no police report was made.

Settlement Discussions

The plaintiff made a demand of $9,999; defendant's offer was waiver of costs.

Damages

The plaintiff sought an award of $75,000.

Injuries

The plaintiff claimed injuries to her neck, shoulders and back. She also claimed she suffered headaches, loss of memory and stomach problems from medication. The defendant disputed the extent of the plaintiff's injuries.
