Lee Jacoby, a 57-year-old paste-up/layout person for a newspaper, was a passenger in a pickup truck that was proceeding on Laguna Street in San Francisco. As the truck passed a moving van parked at the side of the road, Britton Holland, who was in a driveway on the far side of the van, began to pull onto the road. The pickup in which Jacoby rode and Holland's vehicle stopped about two to three feet from one another. Holland subsequently popped the clutch of his car, which caused it to lurch forward and strike the pickup. Jacoby sued Holland, alleging vehicular negligence. Holland stipulated to liability, but disputed the cause and extent of Jacoby's injuries.

Jacoby claimed that she sustained soft-tissue injuries to her neck, shoulder and arms, and that she later felt symptoms in her knees, feet and hand. Holland contended that the minimal impact of the accident could not have resulted in any injuries and maintained that Jacoby was in an accident a month beforehand, and that she had a history of chronic pain.
Result
The jury awarded $689 for past medical costs and $122 for past loss of earnings.
