Facts
On December 17, 1992, Defendant Hassan Vahdkhan was driving south on the 101 Freeway in the number 2 lane at 45 mph in a Chevy Cavalier station wagon in Camarillo on a dark and rainy afternoon. An unidentified automobile cut him off, causing Defendant to slam on his brakes to avoid a collision with this vehicle. Defendant lost control of his vehicle, spun 180 degrees, and came to rest facing north in the number 1 lane. He was then struck in a head-on collision by Plaintiff Woon Chong, a 23-year-old garage door installer. Plaintiff had been heading south at 55 mph in a Toyota pick-up truck. The force of the collision was substantial; both cars were totaled; there were no witnesses; and Plaintiff did not see the unidentified vehicle.
