The subject 102-unit condominium was completed in August of 1987. The unit prices ranged from $300,000 to $800,000. Occupancy included many elderly residents.

Settlement Discussions

Plaintiffs contend that, at a formal mediation, they made a demand of $13,000,000 and Defendant offered $3,500,000; during trial Plaintiffs demanded $9,900,000 and Defendants offered $7,000,000. Defendant contended Plaintiffs' initial demand for more than one year of mediations, was $20,000,000; reduced to $18,500,000; prior to trial Defendants made a 998 offer of $7,000,000 (in March) increased to $7,900,000 at the commencement of trial in April.

Damages

$16,000,000 in property damage (per Plaintiffs). $20,000,000 for repairs and relocation (per Defendants).
