Facts
On February 18, 1993, Plaintiff Ada Bebber, a 56-year-old waitress, slipped and fell on water after stepping off a mat at the entranceway of Defendant Ralphs Grocery Company. There had been heavy rains that day.
Settlement Discussions
Defendant contends it offered between $40,000 and $50,000 (informally) and that Plaintiff made a 998 demand in the amount of $995,000, reduced to $300,000 prior to trial. Plaintiff contends she made a 998 demand in the amount of $299,000 and that she then made an erroneous 998 demand in the amount of $995,000, reduced to $300,000. Plaintiff further contends that Defendant never offered between $40,000 and $50,000; and that instead, Defendant informally offered $30,000.
