Facts
On May 2, 1991, Plaintiff's adult son, a 42-year-old truck driver made an unsafe lane change on northbound I-710, causing a serious collision; he was ejected from the truck through the driver's door and died immediately. The truck, a 3-axle tractor/trailer rig which the decedent had been driving at the time of death, had no seat belts; it was registered to his Defendant brother-in-law. The decedent had been using the vehicle for approximately 2 years prior to the subject accident and sharing the earnings with his brother-in-law. Plaintiff was the decedent's 86-year-old mother who resided in Louisiana and was not receiving financial assistance at the time of the death of her son, but had received support from him in the past.
Settlement Discussions
Plaintiff contends she demanded the policy limit of $250,000 and Defendant made a 998 offer of $45,000. Defendant contends its offer was increased to $75,000 prior to this result.
