Facts

The plaintiff was an invited guest at the defendant Manvelian's home for a birthday party. In preparation for the party, the defendant had barbecued meat and other vegetables prior to her guests' arrival in her balcony. The plaintiff was injured when she slipped and fell in the balcony on oil.

Settlement Discussions

At mediation, the defendant's final offer was $150,000 which was rejected. After mediation, the plaintiff made a C.C.P. Section 998 demand of $200,000; the defendant made a C.C.P. Section 998 offer of $150,000. The case was settled for $175,000 two months prior to trial.

Injuries

As a result of the fall, the plaintiff suffered a broken left ankle, fracture of the mid shaft of the fibula, destruction of the syndesmosis, destruction of the deltoid ligament and posterior malleolar fracture. The plaintiff underwent surgery approximately four days later, when hardware was placed in her leg. A second surgery was performed to remove some of the hardware. The plaintiff has residuals of numbness in her left leg and two visible scars and is unable to resume playing tennis or exercising due to a decreased range of motion and fear of injuring her leg.
