Facts
The plaintiff, Matthew Meshekoff, was a beneficiary of the estate of his aunt on his father's side, Helena Carter Meshekoff. The plaintiff filed his complaint on March 8, 2004 and attempted to overturn Helena's will based upon allegations of extrinsic fraud. The decedent's will was admitted to probate on May 2, 2000 and the final order for distribution was issued on Dec. 31, 2000. The plaintiff received all required notices and brought a Petition to Compel concerning Helena's trust and a Motion to Vacate concerning Helena's will in April 2001. He also sued the executor of Helena's will and other individuals in a purported elder abuse/wrongful death lawsuit filed in Beverly Hills on Jan. 31, 2003.
Settlement Discussions
The plaintiff demanded $1 million. Green offered a waiver of costs.
Damages
The plaintiff sought to recover all of the decedent's assets, including a multi-million dollar estate in Beverly Hills and several million dollars in cash and marketable securities, which he estimated to be worth $5.5 million.
Result
The case was dismissed pursuant to the plaintiff's request following the court's sustaining of demurrer without leave to amend. No appeal filed.
