Facts
The plaintiff contended that the defendants failed to properly manage the plaintiff Jonnie Mize's labor and delivery which resulted in a placental abruption and fetal demise. As to the defendant hospital, the plaintiff claimed that the nurses failed to follow-up two telephone calls to demand the defendant Dr. John Lovejoy should come urgently to the hospital when they felt placental abruption was occurring. As to the defendant Lovejoy, the plaintiffs contended that he should have arrived at the hospital sooner than 35 minutes after the nurses' second telephone call. Further, they contended he should have taken a greater leadership role to determine that a stat c-section be done within 20 minutes of fetal heart tones dropping into the 80s (as opposed to 40 minutes from calling stat c-section to incision and 43 minutes to delivery). The defendants denied negligence and causation.
Settlement Discussions
The plaintiffs indicated a willingness to accept pretrial $150,000 to $200,000. At trial, the jury was asked to award $300,000. The defendant hospital offered $29,999.
