Facts

Maximino Formeloza, a 40-year-old certified hemo-dialysis technician, was working at Alpha Therapeutic in Long Beach on June 28, 2000, when he slipped and fell in the hallway as he was about to leave. Jeffrey and Vickie Wulwick operated S&W Maintenance, the cleaning service that cleaned Alpha Therapeutic's office daily. Formeloza and his wife, Geneva, sued the Wulwicks, alleging negligence and dangerous condition.

Settlement Discussions

The plaintiffs made a C.C.P. Section 998 demand of $175,000, inclusive of any workers' compensation lien. The defendants made no offer.

Injuries

Formeloza sustained a torn anterior cruciate ligament in his right knee. He declined the advised surgery due to fears that he might have complications from his diabetes. Geneva filed a claim for loss of consortium. The Wulwicks disputed that the surgery was necessary.
