Facts

On Oct. 25, 2001, at approximately 5:30 p.m., Erin Bennett was parked on Victory Boulevard, between Mason Avenue and De Soto Avenue, in Woodland Hills. Kristen Rodner, who was parked directly in front of her, began to pull a Toyota RAV4 owned by her parents, Howard and Darlene Rodner, out into the number 3 lane of Victory Boulevard. As she pulled onto the road, her car collided with a Lexus driven by Mehrded Valikhani, 43, in which 9-year-old Ross Valikhani was riding.

Settlement Discussions

Mehrded Valikhani demanded $89,570; $57,625 from Fariba Pakdaman, and $5,000 from Ross Valikhani. No offer was made from the defendants.

Damages

Mehrded Valikhani claimed $1 million in non-economic damages. Ross Valikhani claimed $15,000 in non-economic damages. Fariba Pakdaman claimed $1 million in non-economic damages.

Injuries

Mehrded Valikhani claimed that he suffered a lumbar disc injury requiring epidural injections. Ross Valikhani claimed that he suffered a knee injury. Fariba Pakdaman claimed that she suffered a lower back injury and loss of consortium.

Result

Motion for summary judgment was granted on causation.

Other Information

Bennett's pre-trial motion for summary judgment on causation was granted. The Rodners settled for a total of $20,000 before trial.
