On July 28, 2002, Nho Thi Nguyen, 62, was shopping at ABC Supermarket in Westminster. She claimed that as she was walking in the grape section of the fruit and vegetable aisle, her right foot slipped on some water and this caused her to fall onto her left knee and head.

Settlement Discussions

The plaintiff demanded $32,526 reduced later to $28,000. The defendant made a C.C.P. Section 998 offer of $7,526. The plaintiff asked the jury to award $25,000.

The plaintiff complained of left knee pain, headaches, nausea and mild dizziness. An examination and x-rays revealed a contused left knee and a CT head scan was normal. She received chiropractic care. She was later diagnosed a surgical sprain/strain with associated headaches. She complained of residual pains.
