Steve White, a 60-year-old farmer, was driving his 1995 Ford Explorer on Main Street at its intersection with Tenth Avenue in Ramona when he was rear-ended by a 1996 Cadillac driven by James Roberts on May 13, 2003. White sued Roberts, alleging vehicular negligence. Roberts admitted liability but disputed the nature and extent of White's injuries and damages.

Roberts argued that White had not proven any loss of wages, as he claimed to have hired high school kids to help him sell fruit at farmer's markets.
Injuries
White complained of numbness in his hands and arms, lumbar strain and aggravation of cervical disc protrusion that would require a laminectomy. Roberts contended that White suffered only a soft tissue injury for which no treatment other than that already received was necessary. Defense expert William Bowman, an orthopedic surgeon, opined that no future surgery would be necessary. The plaintiff's expert, William Taylor, testified that the plaintiff was a surgical candidate in the future, but did not know when.
