On August 11, 1993, Plaintiff, a 61-year-old candy importer, had just returned home to his Oxnard condominium. He was handicapped through hip, knee, and shoulder injuries sustained as a childhood victim of polio and an adult victim of an unrelated automobile collision. His second-story patio floor was under reconstruction due to water damage. Unaware that the flooring had been removed by Defendant contractor, Plaintiff stepped out onto his patio deck and fell partially through the exposed joists; he extended his arms to stop himself. Defendant homeowners association had retained the Defendant contractor to repair and retrofit leaky patios, following condo-building defect litigation.
