On June 24, 1994, Plaintiff, a 18-year-old student, had just graduated from high school. While attending a graduation/birthday party, Plaintiff left as a passenger in a car driven by Defendant friend; both had been allegedly drinking and smoking "grass" Later, the pair picked up 4 more passengers. Shortly thereafter, the automobile left the road at a high rate of speed and crashed the passenger side into a tree. Two claims were settled with the third-party insurers of Defendant driver/owner of the vehicle for $184,000; Plaintiff filed the subject claim under his parents' underinsured policy.

To date Plaintiff has undergone seven surgeries, and 75-day hospitalization. Plaintiff claimed permanent disability, restricted future employment, and future knee replacement.
