Facts

On November 22, 1992, Defendant police deputies became involved in a vehicular pursuit of a suspect that had identified to them as having just robbed an individual at gunpoint. The pursuit by Defendant deputies went approximately 1.75 miles with speeds approaching 70 mph. During pursuit, the suspect's vehicle went into oncoming lanes of traffic, spun out at one point, and ran one stop sign and two red traffic lights. The chase ended when the suspect ran a traffic light at the intersection of Broadway and Imperial Highway and struck an automobile in which Plaintiff was a rear seat passenger, in a broadside collision. At the time Plaintiff was a 46-year-old gardener.
