Facts

Decedent was working as a flagger at a roadside construction site. Defendant fell asleep at the wheel while driving past decedent's work site. Defendant veered off the highway striking and killing decedent instantly. At the time of the incident, defendant was working in the scope of his employment for the county library system dropping off and picking up books. Plaintiffs, who are decedent's husband and children, brought a wrongful death and other causes of action.

Settlement Discussions

The plaintiffs demanded $525,000.

Other Information

The case against the State of California was dismissed. The worker's compensation claim was also released based on lack of employer negligence.
