Facts

On Feb. 7, 1999, plaintiff and defendant were involved in a vehicle accident in Newport Beach. Plaintiff, who was 83 years old, was a front seat passenger in defendant's vehicle. Defendant made a left turn into oncoming traffic. Defendant's vehicle was totaled. Plaintiff spent 28 days in the hospital. The plaintiff contended that the defendant negligently turned left into oncoming traffic. As plaintiff was a seat belted passenger, there was no issue of comparative negligence.
