Facts

The plaintiff, a 53-year-old carpenter, fell through one of several openings in a roof he was retrofitting. He had been working on the roof for approximately one week. The plaintiff alleged that he fell into a roof opening which was left unmarked and unattended by other worker. Defendant No. 1 owned the building he was retrofitting; Defendant No. 2 was the general contractor. The plaintiff was an employee through a temporary agency for the general contractor.

Injuries

The plaintiff sustained six fractured ribs; punctured lung; lacerated diaphram; perforated intestine; ruptured spleen; torn meniscus; and spinal injury. Emergency surgery was required to remove his spleen, repair his lung, diaphram and intestine. Subsequent surgery was required to repair his knee and fuse his spine. Presently, the plaintiff requires ongoing care to his back and possibly needs another surgery. Plaintiff was rendered permanently disabled.
