Facts

James Halloran, 56, was employed by Pilkington North America Inc. as a store manager. Pilkington was a manufacturer of glass and glazing products for the building and automotive industries. Halloran oversaw all purchases and distribution of raw materials and supplies for Pilkington's Lathrop plant. After 32 years of employment and numerous promotions, Halloran was terminated on Feb. 19, 2001. Halloran sued Pilkington; his manager, Todd Huffman; his direct supervisor, Tammy Tolbert; and the head of human services, Sue Lamberth. He alleged wrongful termination in violation of public policy, age discrimination and harassment, breach of express and implied contract, intentional infliction of emotional distress, negligent infliction of emotional distress, and failure to prevent harassment.

Settlement Discussions

Halloran made a C.C.P. Section 998 demand of $289,000. The defendants made a confidential offer.

Damages

Halloran sought $327,368 in past and future economic loss earnings.

Injuries

Halloran complained of emotional distress. He did not seek treatment, but maintained that he had physical symptoms of depression and anxiety.

Other Information

The jury awarded economic damages of $327,368 and non-economic damages of $1.04 million. Halloran also received punitive damages of $750,000. Halloran was awarded fees, costs and interest.
