On June 14, 2008, Fulgencio Chimil drove his vehicle with his wife, Maria Bracamontes, as a front seat passenger, and Cristobal Chimil, their son, in the back seat. Chimil was involved in a vehicular accident with Maybeen Polanco. The family sued Polanco and her husband, Carlos Palma, alleging motor vehicle negligence.

PLAINTIFF'S CONTENTIONS:
Plaintiffs argued that Polanco made a dangerous left turn in front of Chimil when he was crossing an intersection on a green light.

DEFENDANT'S CONTENTIONS:
Defendants argued that Chimil changes lanes after stopping behind a car, driving into the intersection although he had a red light. Further, defendants claimed that the turn Polanco made was proper.
