Facts

United Airlines had a sick leave policy whereby pilots were give five hours of sick leave for every month of work and could accrue up to 1,000 hours. Air Line Pilots Association International, Richard Ferguson, Geoffrey Evans, and Kathleen Wentworth filed a lawsuit against United Airlines in relation to the sick leave policy.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiffs claimed that defendant failed to permit employees to utilize sick leave required to take care of an ailing relative. Further, Wentworth alleged that she had to take unpaid leave to care for her dying mother. Plaintiff also claimed violations of Labor Code Sections 233 and 234, and a Business a Professions Code Section 17200 violation.

Result

The court awarded plaintiff Wentworth $4,358 in restitution. The court also permanently enjoined defendant from denying pilots sick leave days to care for sick family members.
