Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that he was a participant and a beneficiary of a group benefit plan that offered long-term disability coverage. Plaintiff alleged that medical providers have diagnosed him with severe chronic headaches, tremulousness, and severe cognitive and executive function impairments, which rendered him totally disabled. His medical providers ultimately diagnosed him with an organic brain disorder. He then filed a claim for long-term disability benefits and provided the requisite supporting documents. However, defendants denied his application "due to insufficient clinical findings." After his appeal was denied, plaintiff sued defendants, asserting violations of the Employee Retirement Income Security Act.
DEFENDANTS' CONTENTIONS:
Defendants denied plaintiff's allegations and asserted various affirmative defenses. Particularly, defendants claimed that plaintiff failed to establish that he suffered from a disability that prevented him from working.
Result
A bench trial was held and the court found in favor of defendants.
