Gabe Beauperthuy filed a collective action against 24 Hour Fitness USA Inc. and Sport And Fitness Clubs of America Inc. alleging violation of the Fair Labor Standards Act (FLSA).

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff contended that personal trainers were required to work off-the-clock performing work related to their job and that defendants failed to pay for overtime. Plaintiffs also contended that managers were misclassified as exempt employees and that defendants failed to pay them overtime.

Result

The parties reached a $17,448,500 settlement.
