Facts

After about three weeks of negotiations in February 1997, plaintiff JEC International Corp, a Japanese tour promoter, entered into an oral agreement with representatives of Chaka Khan for a 12-date concert tour in Japan to occur in May and June 1997. JEC immediately began preparation for the tour. Within a short period of time, however, a second Japanese tour promoter, Creative Man Productions, announced in Japan that it would be the tour promoter for a Chaka Khan tour in Japan in May 1997. Ultimately, Chaka Khan did the May 1997 tour in Japan with Creative Man. As a result, JEC was forced to cancel the tour it was planning and was required to make out-of-pocket cancellation fees to venues and other tour support companies with which it had already contracted. The plaintiff brought this action against the defendants based on breach of contract and intentional misrepresentation.

The verdict was reached approximately one year and four monhts after the case was filed. A settlement conference was held on July 17, 1998, before Judge Marshall did not resolve the case.
