Facts

On May 9, 1996, plaintiffs George Manos, a 35-year-old self-employed electrician, and Judi Tynon, a 32-year-old homemaker, were traveling in plaintiff's Camaro, heading south on Woodruff. The plaintiff driver, Manos, was intending to pass through Willow. At the same time, defendant Carmella Bryan turned her 1994 Jeep Cherokee left from northbound Woodruff to westbound Willow and collided with plaintiffs' vehicle. The defendant claimed plaintiffs' vehicle did not appear close enough to constitute a hazard. The plaintiffs brought this action against the defendant based on negligence.

Settlement Discussions

The plaintiffs made a C.C.P. º998 settlement demand for $14,000 and $3,000. The defendants made a C.C.P. º998 offer of compromise for $12,000 and $3,000.

Specials in Evidence

$7,500 (Manos); $2,013 (Tynon)

Injuries

Plaintiff Manos alleged soft tissue muscle strain injuries to neck and back with no residuals. Plaintiff Tynon claimed left elbow clicking and popping sensation.

Other Information

The verdict was reached approximately one year and seven months after the case was filed. An arbitration held on Dec. 17, 1997, before retired judge John S. Cane resulted in an award of $3,114 for plaintiff Manos and $2,013 for plaintiff Tynon. The plaintiffs requested a trial de novo.
