On June 22, 1997, plaintiff Jesus Gonzalez, a 20-year-old farm laborer, was riding a bicycle in a residential neighborhood of an unincorporated area of Bakersfield when he was confronted by a pack of dogs which began to chase him. The plaintiff was traveling northbound. In an attempt to evade the dogs, the plaintiff increased his speed and traveled into the southbound side of traffic. He struck the front end of the defendant's truck which was traveling southbound on the southbound side of the street. The plaintiff brought this action against the defendants based on negligence. In addition to driver Garcia, the plaintiff named defendant Vargas as owners of the dogs.

The plaintiff made settlement demand for $15,000 (policy limits). The defendant made a C.C.P. º998 offer of compromise for a waiver of costs.
