Plaintiffs filed a class action against CitiMortgage Inc. seeking to certify eight statewide classes of individuals.

Contentions

PLAINTIFFS' CONTENTIONS:
Plaintiffs asserted that Citi breached the Trial Payment Plans (TPP) to provide a permanent modification or a written denial by the Modification Effective Date (MED) was a common question of law that was amendable to class certification. As such, plaintiffs contended that class certification was appropriate.

Result

U.S. District Judge Dale S. Fischer denied plaintiffs' motion for class certification.
