Facts

On Nov. 3, 1998, plaintiff George Reed III robbed an Oakland gas station at gunpoint. Police officers pursued and arrested him. Reed brought suit against the officers and the Oakland Police Dept. for applying excessive force during his arrest. Except for Officer Ervin Romans, who was on the scene, defendants successfully filed a summary judgment motion. Romans passed away and his estate was substituted in his place.

Contentions

PLAINTIFF'S CONTENTIONS:
Reed contended that Romans watched as another officer used excessive force on Reed and he failed to stop that officer.

Injuries

Reed claimed head injuries that required emergency medical attention.

Result

A verdict was entered for the defense.
