Facts

On April 13, 1993, the plaintiff husband, William McNames, a research attorney for the Orange County Superior Court, was traveling westbound on Fourth Street in the city of Santa Ana. Defendant Patricia Louise Hubbard, a court reporter, was traveling southbound on Lyon Avenue from a stop sign, attempting to make a left turn onto eastbound Fourth Street. The defendant allegedly did not see the plaintiff's vehicle and they collided in the number one westbound lane of Fourth Street. The plaintiff's 1981 Oldsmobile Cutlass was deemed a total loss. The defendant's 1992 Mercedes sustained property damage in excess of $22,000. The plaintiffs, the driver and his wife, brought this action against the defendant based on negligence and loss of consortium theories of recovery.
