On June 4, 1993, the plaintiff husband, Vahik Aghadjanian, a 43-year-old messenger, was driving his car when the vehicle operated by defendant Barbara Frank rear-ended the plaintiff's vehicle. The speed of the defendant's vehicle at the time of the impact was disputed. The defendant's vehicle sustained $4,500 of front-end damage. The plaintiffs, Vahik Aghadjanian, his wife and son, brought this action against the defendant based on negligence and loss of consortium theories of recovery.
