On July 24, 1994, the plaintiff, Shirley Weippert, a 34-year-old shoe store assistant manager, was shopping in defendant Smith's Food and Drug Centers, Inc.'s market when she slipped in a small puddle of water on the floor. The plaintiff fell, injuring her wrist. The plaintiff estimated that the puddle contained approximately one gallon of water. The plaintiff brought this action against the defendant based on premises liability and negligence theories of recovery.
