Facts

The plaintiff, Sharon Fox, a 52-year-old medical device assembler, alleged that on February 7, 1994, while exiting the defendant's, Albertsons, Inc. ("Albertsons"), store, a loss prevention agent of the defendant, Securco, Inc. (the security provider for the defendant, Albertsons), grabbed her arm and demanded her purse. The plaintiff further alleged that the undercover guard did not identify himself and she thought he was a criminal who was going to mug her in the parking lot. The plaintiff brought this action against the defendants, Albertsons and Securco, based on assault, battery, false imprisonment and infliction of emotional distress theories of recovery.

Settlement Discussions

The plaintiff made a settlement demand for $70,000, which was reduced to a $40,000 C.C.P. º998 offer of compromise prior to trial. The defendants made a C.C.P. º998 offer of compromise for $10,000.
