Facts
Plaintiff Mary Jane Williamsonon on behalf of a class of persons, through her guardian ad litem James Elliott, alleged that defendants failed to provide the adequate number of nurses per patient per day. The plaintiffs believed that defendants understaffed their facilities intentionally in order to maximize profits and provide bonuses to the officers and directors of the company. The plaintiffs also claimed false advertising for defendant's businesses.
The plaintiff brought a class action lawsuit against defendants contending unfair and deceptive business practices, consumer protection violations, and health and safety code violations.
Result
The defendants agreed to pay a total of $3 million into a settlement fund. Each class member was entitled to $.80 for each day they resided in defendant's facilities. If the claims totaled more than $3 million the claims were to be prorated. Plaintiff Williamson was awarded $5,000 as an incentive award for being the representative plaintiff. The plaintiff's counsel was awarded $600,000 in attorney fees and costs.
