Hratch Tasmajian was directing an assistant to hitch their tractor to a trailer when Jesus Escajeda backed his tractor over Tasmajian's foot. He sued Escajeda and Escajeda's employer, Road West Transportation, for negligence.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff contended defendant breached its duty of care when backing up his truck. Plaintiff was not aware of defendant's tractor while directing his helper to hitch their tractor to a trailer.
DEFENDANTS' CONTENTIONS:
Defendants contended plaintiff was 70 percent negligent for the accident because he should have been more aware around other moving tractors.
Damages
Plaintiff sought $750,000 to $1.2 million for pain, suffering, lost wages and lost income.
Injuries
Plaintiff suffered lis franc fracture and dislocated various foot joints and suffered from knee, shoulder and back pain.
Result
The court found Escajeda and Roads West 60 percent liable for the accident. Tasmajian was awarded $607,690 plus costs of $9,045 and post judgment interest of $1,690 totaling $618,425.
