Robert Jackson sued the County of San Bernardino and Detective Bannes in connection with an incident that allegedly occurred on Oct. 27, 2011.
Contentions
PLAINTIFF'S CONTENTIONS:
Defendants allegedly went to plaintiff's house to investigate a crime and, in an attempt to take plaintiff into custody, the officers forced plaintiff out of an attic through use of a Taser, causing him to fall. Plaintiff's injuries rendered him paralyzed. As such, plaintiff sued defendants alleging causes of action for unreasonable search and seizure (excessive force), municipal liability for unconstitutional custom or policy, battery, and negligence in use of force.
DEFENDANTS' CONTENTIONS:
Defendants denied plaintiff's allegations, claiming the officers used the Taser on plaintiff after he had already fallen from the attic and was moving upright into a charge or flight mode.
Result
The jury unanimously found in favor of the County of Los Angeles and its officers.
